What is Judiciary? What provision has been related to judiciary in the present constitution of Nepal?

Judiciary is the system of courts that adjudicates legal disputes and interprets, defends and applies law in legal cases as well as rights and freedom of the people.

Part 11 of the constitution of Nepal has the provision related to Judiciary. Judiciary consists of three layers of court.

The structure of Judiciary is given in a table below.

Level of Court Number of Court Description
Supreme Court 1
  • There shall be one supreme court in Nepal.
  • It is also called court of records.
  • The jurisdiction of supreme court shall be considered the final one.
  • There is 1 chief justice and maximum 20 judges in supreme court.
  • Chief justice is appointed by the president on the recommendation of constitutional council.
  • Other judges are appointed by the president on the recommendation of judicial council.
  • Chief justice holds the post for 6 years but retires even early if s/he crosses 65 years.
High Court 7
  • There is 1 high court in seven provinces each.
  • It performs judicial function within the respective province.
  • There is provision for 1 chief judge and other judges according to the federal law.
  • The judges re appointed by the chief justice on the recommendation of judicial council.
District Court 77
  • There is one district court in every district.
  • It performs the judicial function of its respective district.
  • It has one chief judge nd other required judges.
  • The judges are appointed by the chief justice on the recommendation of judicial council.
